Cleveland real estate agent Ryan McCann's court case has been delayed a week after confusion over his bail conditions.
The 36-year-old, who has been charged with 34 drug-related offences, had his case mentioned briefly in Wynnum Magistrates Court on Monday.
But the committal mention was stalled when Magistrate Zac Sarra questioned the legitimacy of a change to McCann's bail conditions that excused him from appearing at the court in person.
The original bail undertaking, provided by Brisbane Supreme Court Justice Peter Flanagan on October 9, ordered McCann to appear at Cleveland Magistrates Court on Monday.
However, McCann's defence team requested that this condition be removed, since his case was due to be mentioned in Wynnum on the same day.
The court also heard McCann could not appear in person as he was in a rehabilitation facility, another condition of his bail.
His defence lawyer said the change to bail had been made by the Office of the Director of Public Prosecutions and Queensland Corrective Services.
Mr Sarra said any change to bail needed to be made by the Supreme Court before he would recognise its legitimacy.
He initially ordered McCann to appear at the court in person by 2pm, or else he would issue a warrant for his arrest.
After speaking with the defence team, Mr Sarra instead adjourned the matter to the same court next Monday.
He said the change would give the defence time to approach the Supreme Court to have the conditions amended.
"(From a community perspective) it's better he embark on his rehabilitation," he said.
"As I understand it (the bail confusion) is happening through no fault of his own."
McCann, who was arrested after a police raid at his Raby Bay house, has yet to enter a plea.
