A CAPALABA man, 27, who threatened his father and talked about stabbing people will need to provide written notice before visiting his parents after twice breaching a domestic violence order.
The man, who has not been named to protect his parents’ identities, appeared at Cleveland Magistrates Court on Tuesday, November 28, flanked by his pregnant girlfriend.
Magistrate Deborah Vasta said she had considered the man’s guilty pleas but warned him to stop blaming others for his own actions.
“You went off your nut,” she said. “(You say) he makes me angry...but there’s only one way to change and that is to change your own behaviour.
“Nothing turns the world upside down like a baby. You need to make sure you’re able to manage that stress.”
The man pleaded guilty to two counts of contravening a DVO and was sentenced to three months in prison suspended for 18 months.
The court heard the man first breached the order in August by staying at his parents’ Alexandra Hills home.
Conditions set on his DVO meant he was not to allowed to do so but both he and his parents had mistakenly believed the order had expired.
The court heard a disturbance at the address was recorded at the time, with the man detained in a mental health service.
The earlier DVO breach was discovered after he lashed out at his father in October.
The prosecution said the man smashed his parents’ coffee table, damaged property and made threats when his father accused him of leaving an iron on.
The 27-year-old later handed himself in to police.
The man’s solicitor said her client, who suffered anxiety and depression, was remorseful for his actions but was adamant he had not smashed the table.
Magistrate Vasta set further DVO conditions including he provide written notice before visiting his parents and banned him from living with them for the next five years.
“You’re 27, you shouldn’t be sponging off your parents,” she said.
He was also required to attend a DV course and counselling as part of his probation.
